TALLAHASSEE, Fla. (WTXL) - Katherine Magbanua, the third suspect charged in the murder of FSU professor Dan Markel will face a jury in January.

This morning, a Leon County judge set her trial date. 

It was scheduled to go for four hours, but only one was needed to set a trial date and get through a motion from the state over who's paying Katherine Magbanua's legal fees.

Her defense team said it would reveal that information only behind closed doors with the judge.

Prosecutors objected, wanting to know whether there might be a conflict of interest, and if the Adelson family was involved.

The judge said a third party has been covering the costs, but he wouldn't say who, except that it is not the Adelsons. Magbanua's attorneys say the state's inquiries into this issue was offensive.

The judge scheduled Magbanua's trial on January 22, 2018, the same day fellow suspect Sigfredo Garcia starts his trial.

The state is considering trying the two cases together, but hasn't filed to do so.

This past Wednesday marked three years since Dan Markel was murdered at his Betton Hills home.
