Tallahassee man arrested on sexual battery charges

TALLAHASSEE, Fla. (WTXL) - A Tallahassee man has been arrested on two counts of sexual battery.

Timothy Victor Simmons, 55, faces two counts of sexual assault on a victim over 12 years of age.

He remained in the Leon County Detention Center on Wednesday with no bond amount set after his arrest on Tuesday.

The victim said Simmons engaged in unwanted sexual acts on Feb. 6, 2018, although in the past the two of them had an intimate relationship, according to a probable cause affidavit.

After leaving the victim at home on the day of the incident, Simmons texted the victim: "I pray you will be alright. I'm so sorry!! Good Night!"

In an interview on Feb. 21, 2018, Simmons denied to a Tallahassee Police Department investigator that he had sent the victim any text messages following the incident.

But, when the investigator showed him an image of the text message, Simmons confirmed he had done so.

Simmons agreed with the victim's sworn version of the event in that, at least twice, he was told "no" but said something similar to "too late" and proceeded with sex acts.
