Man Arrested for Sexual Battery on a Helpless Victim

TALLAHASSEE, Fla. (WTXL) - Police have arrested a man accused of raping a woman while she was asleep next to her boyfriend. 

Nichlas Johnson was arrested on Wednesday and charged with sexual battery on a helpless victim.

According to a probable cause document, the victim told police that on March 18, she was having drinks at her house with a couple of friends. One of the people in the group got a text to go over to her co-worker's house.

When they arrived, Johnson was also there drinking. They said that he was known to stay with the co-worker.

The victim told police that soon after she went to her boyfriend's house with her friends. Not too long after they arrived, her co-worker and Johnson arrived at her boyfriend's house as well.

The document says that several other people were at his house as well.

At some point, both the victim and her boyfriend went upstairs and fell asleep.

Later in the night, the victim said that she woke up to someone having unprotected sex with her. She originally thought it was her boyfriend until she she saw that he was on the other side of her, still asleep.

Police said that the victim pushed the man away and asked who he was. The victim said that she went into the bathroom and turned on the light to see that the man was Johnson.

She told him to get out and he left. The victim told police that she didn't tell her boyfriend because she didn't want him to "do anything bad."

The next day, she told him and her friends what happened. She then went to a local hospital for treatment and evaluation.

The victim told authorities that while she had been drinking earlier during the night, she didn't have any alcohol at her boyfriend's home, saying that she was "very aware."

The document said that Johnson admitted to the crime when police interviewed him.

Johnson was booked into the Leon County Jail. Bond has been set at $25,000.
